OCS Talaam, five others to remain in custody pending bail application

The High Court in Kibera has ordered that former Central Police Station OCS Samson Talaam and five others charged with the murder of blogger Albert Ojwang remain in custody until September 30, when the court will deliver its ruling on their bail application.
Justice Diana Kavenza said the decision will be rendered at midday in open court.

The matter came up for mention on Thursday, with all six accused persons, including Talaam, appearing virtually from remand. The court will determine whether the suspects will continue to be held in custody or be released on bail pending trial.
Those charged alongside Talaam are Police Constable James Mukhwana, Peter Kimani, John Ngige Gitau, Gin Abwao, and Brian Mwaniki Njue. The six were charged in June with Ojwang's murder, and all pleaded not guilty before the Kibera Law Courts.
Defence lawyers had urged the court to grant their clients bail, arguing they were not flight risks. The prosecution opposed the request, claiming the accused were likely to interfere with witnesses and tamper with crucial evidence.
Justice Kavenza had earlier directed that a pre-bail report be filed to guide her decision.
Ojwang, 31, died on June 8, 2025, while in custody at Central Police Station.
Police initially reported that he had sustained self-inflicted injuries after being arrested for allegedly defaming the Deputy Inspector General of Police.
However, a post-mortem conducted the same day established that Ojwang died from physical assault.
